"On October 26, 2007,United States District Judge Jeffrey S. White entered an agreed
preliminary injunction order prohibiting Laing Thermotech, Inc. from further
manufacturing, importing, using, selling, and/or offering for sale the AUTOCIRC2 water
pump and bypass valve system in the United States for the duration of the patent
infringement lawsuit. Judge White also entered an agreed order staying the litigation for
ninety (90) days while the parties pursue further settlement discussions. The lawsuit is
pending in the United States District Court for the Northern District of California and was
filed in August 2007 by Grundfos Pumps Manufacturing, Corp. The suit charges Laing
Thermotech, Inc. with infringement of United States Patent Nos. 7,073,528 and
6,536,464. The patented technology relates to water control valves that are adaptable for
use with a pump and bypass valve so as to bypass cold or tepid water away from the
associated fixture until it reaches the desired temperature. Due to the ongoing nature of
this litigation, Grundfos employees cannot comment on this lawsuit. Any inquiries
