Terms and conditions for entering the draw of the day

The following terms and conditions apply to the prize draws (the "Draw of the Day") organized by Grundfos Holding A/S, Poul Due Jensens Vej 7, Bjerringbro, Denmark ("Grundfos") during the ISH exhibition in Frankfurt am Main, Germany from the 11 – 15 March 2019 (“ISH”).

 

1.      CONDITIONS FOR ENTERING THE DRAW OF THE DAY

To participate in the Draw of the Day, you must provide Grundfos with a permission for Grundfos to send the participant marketing materials. This marketing permission involves that the participant in the applicable form will give Grundfos its name, e-mail address, country of residence and area of interest. Also, to enter the Draw of the Day, the Participant will have to accept these terms and conditions and privacy policy

When the participant has provided Grundfos with this marketing permission and accepted these terms and conditions and the privacy policy, and validates their e-mail, the participant is given one ticket in the Draw of the Day.  

The participant may only enter the competition one time every day, i.e. from 11 to 15 March 2019. To participate in the Draw of the Day, the participant must enter the Draw of the Day no later than 16:00 (4:00 pm.) of the exhibition day. If the participant enters the Draw of the Day after this time, the participant will automatically be part of the following exhibition day’s Draw of the Day, except for 15 March 2019 where there will not be no competition the following day.  

No purchase is necessary to enter or win.

 

2.      DRAWING OF THE WINNERS

The winners will be drawn at random from all valid entries. There will be drawn three winners per exhibition day. The winners will be contacted by email at 17:00 (5:00 pm.). If the winners are present at the exhibition, they will be given the prize directly, if they show up at the Grundfos booth before 17:30 (6:30 pm.).

If the winners are not present, the prize will be sent to their home address as provided by the winner.

If the winner cannot be contacted (i.e. the winner’s e-mail address is not confirmed), or the winner does not revert with a postal address to which the prize must be sent within ten days of notification, Grundfos reserves the right to withdraw the prize from the winner and pick another winner.

 

3.      PRIZES

All participants in the Draw of the Day, qualify for a chance to win the following prizes each exhibition day of the ISH:

  • 3 pairs of VR (virtual reality) headsets. The value of each headset is approximately EUR 300.

The prize cannot be exchanged into cash or other products/goods.

 

4.      TAXATION OF THE PRZE

The winner could be taxable of the prize in its local country. Therefore, the winner might by obliged under local law to recognize the value of the prize. If in doubt, the participant should seek local advice at his/her own costs.

 

5.      CANCELLATION AND CHANGES

Grundfos is entitled to cancel or change the scope of the Draw of the Day at any time due to unforeseen circumstances and the participants are not entitled to any compensation in this regard.

 

6.      GRUNDFOS LIMITATION OF LIABILITY

Grundfos will only be liable for intent and gross negligence.

 

7.      LAW AND VENUE

All matters arising out of or relating to these terms and conditions are governed by and construed in accordance with the laws of Denmark. Any recourse to courts of law is excluded. This provision is void where prohibited or restricted by law. In this case, any dispute or claim arising out of or in connection with these terms and conditions, which the parties have been unable to settle amicably, must be settled by the courts of Denmark.

 

PRIVACY POLICY FOR THE DRAW OF THE DAY

 

1.      WHICH PERSONAL DATA IS COLLECTED

When entering the Draw of the Day Grundfos registers your name, e-mail address, country of residence and area of interest (“Personal Data”).

You are free to decide whether you want to provide your Personal Data to Grundfos. However, you are obliged to provide the Personal Data to participate in Draw of the Day. If you do not provide the Personal Data, you will not be able to participate in Draw of the Day.

 

2.      THE PURPOSE OF COLLECTION OF PERSONAL DATA

Grundfos is collecting, storing and processing Personal Data about participants for the purpose of the Draw of the Day itself and for sending an email if the relevant contestant has won a prize.

 

3.      THE LEGAL BASIS FOR COLLECTING PERSONAL DATA

The processing of your Personal Data is based on your freely given, specific, informed and unambiguous consent, that you will enter the Draw of the Day, and that the processing of your Personal Data is necessary for the fulfilment of the purpose mentioned above, cf. Article 6, para. 1, lit.a of the General Data Protection Regulation (Regulation (EU) 2016/679).

 

4.    DETAILS OF THE DATA CONTROLLER AND RECIPIENTS OF THE PERSONAL DATA

Grundfos Holding A/S, Poul Due Jensens Vej 7, 8850 Bjerringbro, Denmark, Reg. No.: 31858356, gfi@grundfos.com and your local Grundfos entity  (jointly referred to as “Grundfos”) are joint data controllers and responsible for data
security and the processing of your Personal Data according to the specific purposes mentioned above.

Grundfos can share your Personal Data with third parties acting as Grundfos’ data processors for processing your
Personal Data according to the purposes mentioned above. The following data processors are used:

  • Microsoft Ireland Operations Limited, Atrium Building Block B, Carmenhall Road, Sandyford Industrial Estate, Dublin 18, Ireland

  • Other local companies within the Grundfos Group that will assist with IT support for the above systems.

  • Other recipients, typically consultants, that will assist with IT support for the above systems and
    assist with the processing of your Personal Data on behalf of Grundfos in the above systems.

Other authorised third parties may need to access or store Personal Data if required or permitted by applicable law (e.g. governmental authorities, courts, external advisers and similar third parties that are public bodies).

 

5.      TRANSFER OF THE PERSONAL DATA

In certain cases, your Personal Data may be transferred to outside of EU/EEA. Grundfos ensures that such transfer will be carried out in accordance with the applicable data protection laws. This entails that any party outside of EU/EEA which comes into possession of your Personal Data must ensure an adequate level of protection, for example by entering into the EU standard contractual clauses, or implement and comply with binding corporate rules, where applicable. 6.      RETENTION PERIOD

Your Personal Data will be stored for processing in 30 days.

Some of your Personal Data may, however, be stored for accounting purposes or for defence of legal claims. This Personal Data will be stored until the expiration of the statutory limitation period. Moreover, some of your Personal Data may be stored in an anonymised form that does not allow you to be identified.

 

7.      HOW CAN YOU ACCESS YOUR PERSONAL DATA? / FURTHER RIGHTS

Underapplicable law, you have various rights (under the conditions set out in applicable law).

Withdrawal of consent: If you have declared your consent for any Personal Data processing activities you can withdraw this consent at any time with future effect. Such a withdrawal will not affect the lawfulness of the processing prior to the consent.

Right of access: You may have the right to obtain from us confirmation as to whether Personal Data concerning you is processed, and, where that is the case, to request access to this Personal Data. The access information includes – inter alia – the purposes of the processing, the categories of Personal Data concerned, and the recipients or categories of recipients to whom the Personal Data has been or will be disclosed. However, this is not an absolute right and the interests of other individuals may restrict your right of access.

You may have the right to obtain a copy of the Personal Data undergoing processing. For further copies requested by you, we may charge a reasonable fee based on administrative costs.

Right to rectification: You may have the right to obtain from us the rectification of inaccurate Personal Data concerning you. Depending on the purposes of the processing, you may have the right to have incomplete Personal Data completed, including by means of providing a supplementary statement.

Right to erasure ("right to be forgotten"): Under certain circumstances, you may have the right to obtain from us the erasure of Personal Data concerning you and we may be obliged to erase such Personal Data.

Right to restriction of processing: Under certain circumstances, you may have the right to obtain from us restriction of processing your Personal Data. In this case, the respective data will be marked and may only be processed by us for certain purposes.

Right to object: Under certain circumstances, you may have the right to object the processing of your Personal Data by Grundfos, on grounds relating to your particular situation, at any time. Grundfos may be required to cease processing your personal data.

Right to data portability: Under certain circumstances, you may have the right to receive the Personal Data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format and you may have the right to transmit that data to another entity without hindrance from us.

8.      FILING OF COMPLAINTS

In case of complaints, you also have the right to lodge a complaint with the competent supervisory authority regarding the processing of your Personal Data.

 

9.       CHANGES OF THE PRIVACY POLICY

We reserve the right to change or supplement this Privacy Notice at any time. The current Privacy Notice will always be available on Grundfos’ company website: www.grundfos.com .
